Himpunan Mansuhkan ISA: 1 Ogos 2009





The ISA violates Islam and those who defend the ISA are defending a haram law. And let me repeat what I have said so many times before. Malays who say “matlamat menghalalkan cara” (the ends justify the means) are munafiq Muslims. Malays who support and defend the ISA are munafiq Muslims. Munafiq Muslims are those who do not walk the talk. Munafiq Muslims are those who talk about Islam but do what Islam forbids.

Penting! Panduan bagi peserta perhimpunan aman Mansuhkan ISA

Himpunan Mansuhkan ISA pada 1 Ogos 2009 di Kuala Lumpur bakal mencipta sejarahnya yang tersendiri selepas Himpunan Bersih dan PPSMI. Uniknya pada hari yang sama akan ada satu lagi himpunan lain yang Menyokong ISA.

Kami menjangkakan pelbagai kaum akan muncul, pelbagai ideologi akan hadir, pelbagai agama dan kepercayaan akan berhimpun untuk menyatakan pandangan mereka khususnya dalam mendesak Kerajaan Memansuhkan Akta Keselamatan Dalam Negeri (ISA).

Oleh itu bagi melancarkan perhimpunan ini, pihak kami mengeluarkan satu garis panduan yang diharapkan dapat membantu anda dan kami diperingkat penganjur dalam memastikan perhimpunan ini dapat berjalan dengan lancar dan aman.

Perkara yang perlu anda bawa/sediakan

1. Kad pengenalan, lesen memandu, satu kad ATM sahaja.

2. Duit-maksimum RM 100 sahaja.

3. Memakai pakaian yang sopan-Baju berwarna Hitam/Merah- Sebaiknya ada logo Mansuhkan ISA

4. Setiap peserta diwajibkan memakai kasut.

5. Aksesori kempen-Button, riben, topi, kopiah arm band, bendera kecil, banner dan placard yang ada Logo atau Slogan Mansuhkan ISA boleh digunakan.

6. Bendera Malaysia atau negeri masing-masing.

7. Air mineral, sedikit makanan ringan atau gula-gula.

8. Sedikit garam-ia penting dan boleh dimakan sedikit (bukan sapu dimuka) bagi mengembalikan tenaga terutamanya jika Pihak Polis sembur air dari Water Canon atau Gas pemedih mata.

9. Kain tuala kecil basah untuk tutup mata dan hidung untuk elak terkena gas pemedih mata.

10. Digalakkan memakai penutup mulut dan hidung jenis N100 Respirator, N95 Respirator dan Surgical facemask untuk mengelak penularan wabak Influenza H1N1 dan juga menghindarkan sedutan gas pemedih mata yang melampau.

11. Jika anda mempunyai asma atau alahan sila bawa inhaler atau ubat sendiri.

12. Sila bawa beg plastik sampah kecil bagi mengelakkan anda membuang sampah merata-rata.

13. Sila bawa pen dan kertas (mini note pad) bagi mencatat nama dan no. pengenalan Polis atau perkara-perkara yang mencurigakan.

14. Perkara yang tidak dibenarkan

1. Jangan bawa kad matrik pelajar bagi student atau pass kakitangan bagi pekerja Kerajaan dan Swasta.

2. Jangan bawa terlalu banyak wang atau kad kreadit untuk elakkan penyeluk saku, tercicir atau hilang semasa perhimpunan atau ditahan.

3. Jangan memakai pakaian yang menjolok mata dan tidak sopan.

4. Jangan memakai selipar, kasut tumit tinggi atau sandal untuk memudahkan pergerakkan.

5. Jangan memakai kain atau skirt, digalakkan memakai seluar.

6. Jangan memakai barang kemas atau aksesori yang tiada kaitan dengan kempen mansuhkan ISA

7. Jangan bawa sebarang banner, placard, bendera yang melambangkan logo parti dan organisasi.

8. Sebarang slogan yang tiada kaitan dengan Kempen Mansuhkan ISA tidak dibenarkan.

9. Jangan bawa sebarang benda tajam kecuali pen.

10. Jangan bawa bahan-bahan yang boleh meletup atau mudah terbakar seperti, mancis, molotov cocktail dan mercun.

11. Tidak dibenarkan merokok semasa perhimpunan kerana akan menganggu orang lain.

12. Jangan bawa sebarang senjata seperti kayu, besi, rantai besi, pistol dan yang merbahaya.

13. Bagi yang membawa anak-anak, anda tidak dibenarkan membawa permainan yang berupa seperti senjata seperti pistol, senapang atau pisau mainan.

14. Jangan bawa anak-anak yang berumur 10 tahun ke bawah bagi mengelakkan sebarang masalah.

Perkara yang perlu anda lakukan sebelum perhimpunan

1. Servis kenderaan dan periksa peralatan yang perlu dibawa.

2. Jangan makan atau minum terlalu banyak sebelum perhimpunan.

3. Pastikan anda telah menunaikan 'hajat' sebelum memasuki perhimpunan.

4. Bagi yang Islam, Lakukanlah solat taubat dan hajat, semoga Allah berkati perhimpunan ini dan yang bukan Islam boleh berdoa mengikut ritual masing-masing.

5. Pastikan anda telah mengunci rumah atau meninggalkan pesanan-pesanan penting kepada keluarga atau jiran anda yang tidak pergi perhimpunan.

6. Maklumkan mereka tujuan anda keluar.

7. Maklumkan mereka nombor telefon sahabat lain yang bersama anda jika handphone anda tidak dapat dihubungi nanti.

8. Jangan lupa charge bateri handphone dan kamera.

9. Pastikan anda berniat kerana Allah (bagi yang muslim) sebelum keluar rumah.

10. Pastikan anda tahu arah tuju anda iaitu tempat berkumpul yang ditetapkan; Sogo, Masjid Jamek, atau Masjid Negara.

11. Pastikan anda datang awal untuk elakkan kesesakan jalan raya atau terpaksa berbaris panjang untuk beli tiket tren LRT atau Komuter.

12. Datang secara berkumpulan, jangan bersendirian.

13. Sekiranya perjalanan anda dihalang dari memasuki pusat bandar anda boleh meletakkan kenderaan dan berjalan kaki ke Sogo, Masjid Jamek, atau Masjid Negara (Jangan terus ke Istana Negara bersendirian) .

14. Jangan memakai baju Mansuhkan ISA sebelum perhimpunan bermula.

Semasa perhimpunan dan perarakan

1. Berkumpul di tempat pertemuan yang ditetapkan (Sogo, Masjid Jamek, atau Masjid Negara) dan tunggu arahan dari Field Commander yang dilantik.

2. Ikutilah arahan dari Unit Amal atau Field Commander sepanjang program. Jangan pedulikan arahan lain tanpa merujuk kepada Field Commander.

3. Jangan berganjak dari tempat perhimpunan melainkan dengan arahan Field Commander.

4. Laporkan pada Unit Amal bertugas jika terlihat sesuatu yang mencurigakan.

5. Jangan tolak menolak sepanjang perhimpunan dan perarakan.

6. Elakkan mencerca, memaki hamun atau menunjukkan isyarat lucah semasa perhimpunan berlaku.

7. Raikan perhimpunan ini dengan aman dan harmoni.

8. Pastikan anda memberikan keutamaan laluan kepada kenderaan yang lalu lalang dan tidak melintas sesuka hati dijalanraya.

9. Pastikan anda memberikan keutamaan, membantu dan melindungi warga emas, orang kurang upaya atau kanak-kanak yang hadir bersama.

10. Maklumkan sahabat anda jika anda ingin keluar dari perhimpunan disebabkan hal kecemasan atau kerana ingin ke tandas bagi mengelakan masalah lain.

11. Pastikan anda dapat duduk semasa pimpinan berucap.

12. Pastikan anda tidak bersembang semasa pimpinan berucap kerana kemungkinan bunyi sound system akan tenggelam dengan suara ratusan ribu peserta.

13. Ikutilah laungan pimpinan jika perlu.

14. Pegang bendera Malaysia atau negeri anda sepanjang perarakan.

15. Jangan buang sampah merata-rata sepanjang perhimpunan. Masukan dalam beg plastik yang anda bawa.

16. Rakamkan suasana himpunan - gambar-gambar atau klip video boleh dihantar kepada kami selepas himpunan di email Setiausaha GMI-enalini_ elumalai@ yahoo.com Alamat email ini telah dilindungi dari spam bots, anda perlukan Javascript enabled untuk melihatnya untuk rekod dan disiarkan.

17. Kalau boleh rakamkan sekali wajah-wajah polis yang bertugas atau tragedi-tragedi penting seperti keganasan atau provokasi Polis jika ada.

Selepas perhimpunan

1. Pastikan anda bersurai secara perlahan-lahan dan dengan aman selepas diberikan arahan bersurai.

2. Pastikan sahabat atau saudara dan anak-anak anda ada bersama selepas perhimpunan. Jika tiada, sila datang ke Pejabat Agung PAS untuk membuat laporan dengan Unit Amal bertugas.

3. Jika ada sahabat atau saudara anda ditahan, jangan terus balik. Dapatkan maklumat di Pejabat Agung PAS atau ke Balai Polis berkaitan untuk bebaskan mereka.

4. Jangan tinggalkan apa-apa sampah ditempat perhimpunan. Pastikan semuanya dibuang ke tong sampah atau dibawa balik dan dibuang dirumah.

5. Berikan ucapan terima kasih kepada pasukan Keselamatan bertugas jika perhimpunan berjalan lancar.

6. Jangan lupa sebarkan gambar dan berita perhimpunan kepada semua sahabat-sahabat terutamanya yang tidak hadir. Segala info dan maklumat bolehlah diemailkan kepada kami di email Setiausaha GMI-enalini_ elumalai@ yahoo.com.

Apa anda perlu buat jika kumpulan Pro-ISA buat Provokasi

1. Jangan pedulikan mereka, diam dan teruskan mengikut arahan Field Commander Unit Amal.

2. Jangan menyahut provokasi mereka, jangan baling apa-apa, jangan tunjukkan isyarat apa-apa pada mereka. Anggap mereka tidak wujud pada hari berkenaan.

3. Jangan hampiri mereka.

4. Jika mereka bertindak agreasif secara tiba-tiba, tahan, jangan pukul tetapi serahkan mereka pada pihak Polis.

5. Jangan lupa buat laporan Polis terhadap mereka jika anda dicederakan atau diganggu.

6. Buat rakaman wajah-wajah mereka jika perlu.

Apa anda perlu buat jika polis buat provokasi dan serbuan

1. Jangan lari atau keluar dari perhimpunan melainkan dengan arahan pimpinan, anda akan mudah ditangkap jika keluar dahulu.

2. Jangan bersendirian, pastikan anda bergandingan tangan dan berdiri rapat-rapat bila polis acah nak buat serbuan atau tembakan water canon.

3. Duduk jika pimpinan arahkan.

4. Basahkan tuala anda dengan sedikit air, dan tekup dimuka bila gas pemedih mata dilepaskan. Basuh muka anda dengan air dan makan sedikit garam jika terkena air water canon berwarna kuning.

5. Jangan melawan atau cuba bertikam lidah dengan polis bila mereka provoke…hanya diamkan diri.

6. Ambil gambar mereka jika sempat.

7. Buat laporan Polis jika anda dikasari.

Apa yang anda perlu buat jika ditahan

1. Jangan banyak cakap dengan polis. Diamkan dan tenangkan diri.

2. Minta nama dan nombor polis yang menahan anda dan tanya dia sebab anda ditahan, seksyen berapa yang digunakan.

3. Berikan maklumat asas sahaja jika diminta seperti nama, no kad pengenalan, alamat rumah (berikan ikut alamat dalam IC sahaja).

4. Jika mereka tanya soal pekerjaan, jawap yang ringkas sahaja. Jangan bagi maklumat yang lengkap.

5. Bagi pelajar, jika mereka tanya anda masih belajar atau tidak, anda hanya perlu jawab "Masih tengah cari kerja" atau berikan jawapan lain yang sesuai. Elakkan mengaku sebagai student. Biar mereka siasat sendiri jika mereka perlukan maklumat lanjut. Jangan jawab soalan yang tidak perlu.

6. Bagi kakitangan Kerajaan jika mereka tanya tempat kerja anda, jawab ”Saya kerja swasta atau kerja sendiri”. Biar mereka siasat sendiri jika mereka perlukan maklumat lanjut. Jangan jawab soalan yang tidak perlu.

7. Minta berjumpa dengan peguam sebelum beri apa-apa keterangan. Peguam akan menunggu diluar balai jika anda ditahan.

8. Kalau boleh jangan beri terlalu banyak keterangan, anda hanya perlu jawab "saya akan bagi keterangan di Mahkamah sahaja". Ingat! Apa yang anda cakap di Balai Polis boleh dijadikan bahan bukti di Mahkamah. Anda berhak untuk tidak memberikan sebarang keterangan kepada Polis melainkan di Mahkamah.

9. Semasa ditahan, jangan pedulikan provokasi polis atau jangan mudah cair bila mereka berlembut.

10. Pastikan anda ingat semua yang berlaku, termasuklah pegawai polis yang tahan dan soal siasat anda.

11. Jangan terlalu risau kerana, diluar balai telah disediakan orang-orang yang akan jamin dan bela anda.

Apa yang anda buat selepas dibebaskan

1. Pastikan semua barang-barang anda dikembalikan oleh Polis.

2. Buat pemeriksaan kesihatan jika ada kecederaan.

3. Buat laporan Polis jika anda dikasari semasa perhimpunan atau semasa ditahan.

4. Ceritakan dan rakamkan pada peguam dan media jika anda dianiaya polis.

5. Jangan lupa catatkan semua yang anda ingat bila balik ke rumah untuk memudahkan anda mengingatinya bila dibawa ke Mahkamah kelak.

6. Pastikan anda ingat dan ambil nombor perhubungan orang yang jamin anda dan juga peguam yang terlibat.

7. Serahkan pada peguam segala maklumat dan gambar yang anda ada tentang himpunan bagi memudahkan pembelaan.

8. Jangan lupa solat sunnat syukur selepas dibebaskan dan kembalilah bertemu dengan sahabat-sahabat seperjuangan.

9. Jangan menyepi dari perjuangan selepas melalui pengalaman ditangkap kerana itu secara semulajadi akan menyebabkan motivasi anda akan menjadi lemah dan anda akan rasa keseorangan.

10. Teruskan perjuangan bersama sahabat-sahabat lain.

11. Sesungguhnya anda akan rasa lebih hebat dan berani lagi selepas ditangkap kerana tidak semua orang berpeluang merasai apa yang anda lalui ketika ditahan.

Perhatian!

1. Pihak kami tidak akan bertanggungjawab terhadap sebarang kesalahan atau pelanggaran undang-undang yang tidak ada kena mengena dengan perhimpunan ini.

2. Pihak kami tidak akan bertanggungjawab terhadap sebarang provokasi atau tindakan ganas yang dilakukan oleh mana-mana pihak secara berkumpulan atau individu.

3. Pihak kami tidak akan bertanggungjawab terhadap sebarang kecederaan yang disebabkan oleh kecuaian atau tindakan diluarkan arahan penganjur.

4. Pihak kami tidak akan bertanggungjawab ke atas sebarang penangkapan yang dibuat kerana pergaduhan atau aktiviti agreasif yang tiada kaitan dengan arahan himpunan ini

Secara keseluruhannya, kita berdoa semoga Perhimpunan ini dapat berjalan lancar tanpa adanya sebarang masalah atau tangkapan.

Kita berharap agar dengan sedikit usaha dan kehadiran kita ini akan dapat memberikan kesedaran kepada pihak Kerajaan dan memberikan laluan untuk Agong mempergunakan kuasa yang ada untuk memperbaiki kelemahan sistem perundangan negara kita.

Ingat, Himpunan Bersih dan PPSMI berjaya menyedarkan Kerajaan kerana kesungguhan rakyat. Maka, kini adalah masa untuk kita berjuang bersama untuk memansuhkan ISA.

Pastikan anda mengikuti arahan-arahan yang diberikan. Sebarang masalah anda boleh rujuk kepada Field Commander atau Unit Amal yang bertugas pada perhimpunan ini.

Ingatlah, peristiwa ini adalah peluang untuk anda sekali seumur hidup dan ianya akan kekal menjadi sejarah yang akan menjadi sebutan kepada anak cucu kita. Jangan lepaskan peluang untuk menjadi sebahagian dari sejarah ini.

续干净与公平选举联盟净选盟BERSIH大集会和废除英文教数理PPSMI大集会812pm的废除内安法令大集会将会是另一个创造历史的事迹。奇怪的是同一天也有一个支持内安法令集会。

我们预测当天将会有各族、各意识形态、各宗教和信仰的人集聚在一起以提出他们的看法,特别是呼吁政府废除内安法令。

因此为了让该集会更顺利,我们发出指南希望可以帮助您和我们主办当局确保该集会顺利及和平进行。

您必须携带或准备的事项:

1. 身份证、驾驶执照和一张ATM卡而已。

2. 最多携带100令吉。

3. 穿着礼貌大体,衣服红色/黑色-最好有废除内安法令的标志(logo)。

4. 所有参与者必须穿鞋子。

5. 宣传品-拥有废除内安法令的标志和口号的按钮、丝带、帽子、kopiah 手带、小旗、布条和大字报 被允许。

6. 国旗或州旗。

7. 矿泉水、一点轻便食物或糖果。

不被允许的事项:

1. 学生请勿携带学生证(kad matrik pelajar);政府和私人机构的员工请勿携带工作证。

10. 不要携带可以爆炸或易燃的物品,如火柴、汽油弹(molotov cocktail)和炮竹。

11. 集会时不允许抽烟,因为这将影响他人。

12. 不要携带任何武器,如木柴、铁物、铁链、枪械及任何危险物品。

集会前必须做的事项:

14. 在集会开始前,不要先穿废除内安法令衣服。

在集会和游行进行时:

1. 集合在规定地点(Sogo, Masjid Jamek, atau Masjid Negara)和等待被选为指挥官(也称战地指挥官Field Commander)的命令

2. 整个活动期间须跟从指挥官(Field Commander)或志工团(Unit Amal)的指令。在没有照会指挥官下,不要理会其他指示。

3. 不要离开集会地点,除了得到指挥官的指示。

4. 一旦发现可疑事物须向志工团报告。

5. 集会和游行期间不要推挤。

6. 在集会进行时,不要侮辱、骂粗话或作出不雅举动。

7. 和平及融洽的进行该集会。

8. 确保您给予交通工具优先使用公路以及不随意走在公路上。

9. 确保您给予出席集会的老人、残障人士和孩童优先,帮助和保护他们。

10. 请告诉您的朋友,如果您因急事或要上厕所而要离开集会,以避免其他麻烦。

11. 确保您坐着如果领袖在演讲。

12. 确保您没谈天如果领袖在演讲,因为众人的声音可以掩盖音响的声音。

13. 如果需要请跟着领袖的口号。

14. 游行时请拿着您的国旗或州旗。

15. 集会期间不要随地乱丢垃圾。把垃圾放进您携带的塑胶袋。

17. 如果可以,请录下警察的相貌或重要事情如暴力或有警察挑畔。

集会结束后:

1. 确保您慢慢及和平的离开如果散会的指令被发出。

2. 当集会结束后,确保您的朋友或亲戚和您的孩子和您在一起。如果没有,请即刻前往回教党总部向志工团报告。

如果支持内安法令集会者挑畔,您须做什么?

1. 不需理会他们,保持安静和继续跟从志工队指挥官的命令。

2. 不需回应他们的挑畔,不要向他们丢任何东西,不需给予他们任何讯息。当着他们在当天并不存在。

3. 不要靠近他们。

4. 如果他们突然攻击,抵抗,不要殴打但是将他们交给警方。

5. 不要忘了向警察报警,如果您被他们致伤或骚扰。

6. 如果需要,录下他们的相貌。

如果警察挑畔和驱散逮捕,您可以做什么?

1. 不要跑或离开集会,除非得到领袖的命令,如果您先离开,您会更容易被逮捕。

2. 如果警方要逮捕或发射水炮,不要单独,确保您手牵手和站密。

3. 坐着如果领袖给命令。

JULY 25 — Here’s the thing about us people in general — we are not very fond of rules. That’s why we like democracy, freedom of speech, freedom of thought, bla bla bla.

That’s also why I first fell in love with punk. But like democracy, freedom of speech, freedom of thought and the like, there will always be jerks who co-opt the damn thing and begin to make rules to suit themselves and their friends.

So despite punk’s infamy for its love of anarchy and freedom, it has sadly been hijacked by jerks who make up all sorts of dogmatic rules, and all of a sudden it’s become nothing more than another exclusive club.

You’re not punk anymore if your lyrics are not socio-political, and you merely sing about love, even though The Ramones, The Buzzcocks and The Undertones all did. You’re definitely not punk if you sign to a major label, even though The Clash, Sex Pistols and The Ramones all did. And so the list goes on and on about what’s punk and what’s not.

But you know what, let them have it. Like some people who say they believe in democracy, freedom of speech and freedom of expression, but still go ape when other people try to talk about something outside their sphere of beliefs, just let them have it. Let them take comfort in the belief that they’re way more enlightened than us puny mortals.

The real test of whether you’re more than just a fair-weather believer is when you’re confronted with something that you’ve never believed in. Can you take it?

Can you give that other person a fair chance to voice his or her opinions? And the thing about punk is, that is really the heart of the matter, to have that ability to really free our minds, to be able to accept anyone and everyone. Because let’s face it, how can we expect people to accept us for who we are when we can’t even give them the same courtesy?

"My dear brothers, take note of this: Everyone should be quick to listen, slow to speak and slow to become angry, for man's anger does not bring about the righteous life that God desires. Therefore, get rid of all moral filth and the evil that is so prevalent and humbly accept the word planted in you, which can save you." (James 1:19-21 TNIV)

If you are a follower of Jesus in Malaysia, you are probably angry. Consider the following:-
1. Two Muslim journalists infiltrate a Catholic church incognito. They had heard that a number of Muslims had been converted to Christianity through this church. They found no evidence of such conversions. During mass they come forward to take the communion wafer. They did not swallow and held the wafer in their mouths till they had left the church building. They then spat out the wafer and took pictures. They then published an article about their "adventure" together with pictures of the spat-out communion wafer. To date there is no reprimand from any official government body. Police reports have been made.

I come from a free church tradition. I believe the communion bread remains bread though I believe the Spirit of Christ is at the Lord's Supper. This is beside the point. Malaysia is a multi-racial, multi-religious country where the constitution protects the dignity of all religions. The silence from the government is deafening. Imagine if some Christian journalists had thrown the Koran on the floor, taken pictures, and published the story. Of course we should forgive our enemies. But there are other issues involved, including holding the government responsible to its call to protect the dignity of all religions.

2. In recent times the Malaysian Anti Corruption Commission (MACC) has been aggressively investigating public servants from opposition parties. (Of course whether a party is considered an opposition party depends on your perspective. In truth the "opposition" parties form the duly elected governments in a number of states.) Christians should be at the forefront of any fight against corruption. But when politicians from the governing party are rarely investigated while so many politicians from "opposition" parties are investigated, something is seriously wrong.

The glaring double standard gives lie to the fact that the Anti Corruption Commission is a non-partisan body committed to eradicating corruption wherever it is found. It seems that the Commission is but a political tool of the ruling party.

3. And now we learn that a political aide, who was interrogated by the Commission, has fallen to his death from the 14th floor of the Anti Corruption Headquarters. He had been taken to the MACC office at 6pm on Wednesday (July 15th) to assist in the Commission's investigation into the alleged abuse of constituency development funds by several state assemblymen. Did he jump? Was he pushed? We do not know. What we know is this. He was interrogated till 3.45am in the morning. In the words of Goh Keat Peng: Why was a witness being held for questioning for ten hours and only released at 3.45am? What kind of case is it and what is the urgency of the case in question that the witness had to be deprived of sleep and forcibly kept awake till 3.45am? Was the nation deemed to be in grave danger had the witness in question been sent home at a respectable time and asked to report again for questioning the next morning?

The nation could endure long years of waiting over so many other much longer pending cases involving so much more public money and have much greater weight in public interest but this particular case could not wait for the next morning when the witness in question would have been fresher and better rested? Like I said, if you are a follower of Jesus in Malaysia you should be angry. I am. Which is why I remember James 1:19-21. I know righteous anger can quickly become unrighteous.

I know that when I get angry my discernment is compromised. I am more vulnerable to manipulation. I become rash and speak and act prematurely. When I am angry, I need to bear in mind at least two things:
1. Unrighteous anger will not accomplish God's purposes. If our concern is to be agents of God's work, unrighteous anger is out.
2. When we are consumed by anger we only see the evil "out there." We stop working at the evil inside us. We forget the ongoing call to "get rid of all moral filth and the evil that is so prevalent" in our own lives. However, fear of unrighteous anger should not paralyse us from doing what is right. Followers of Jesus are called to speak up against injustice. "Speak up for those who cannot speak for themselves, for the rights of all who are destitute. Speak up and judge fairly; defend the rights of the poor and needy." (Proverbs 31:8-9 TNIV)".

And as John the Baptist discovered, "speaking truth to power" may demand the highest price (Matthew 14:1-12). There is a time to speak up. There is a time to act. There is a time for righteous anger. But we must guard our hearts and ensure that all we say and do flow out of the twin loves for God and neighbour (Mark 12:28-31). Whatever righteous anger may look like, it must come from a heart that has such a deep passion for God that we are deeply pained that His ways are violated. It must come from a heart with such a deep compassion for human beings (of whatever race or religious background) that we are roused when human life is violated. And it must come from a heart that is always suspicious of its own righteousness.

Ean Yong’s Political Secretary Dead At MACC HQ

SHAH ALAM, July 16 – The Malaysian Anti-Corruption Commission’s (MACC) controversial probe into several DAP assemblymen’s activities was thrown into more turmoil today with the death of political aide Teoh Beng Hock at the anti-graft authority’s Selangor headquarters.

The 30-year-old’s death will put more pressure on the MACC, which has been accused by the opposition of conducting selective investigations.

By 9pm tonight, a crowd had gathered at the scene for a candlelight vigil in his memory, which soon grew into a protest with angry chants of “Najib pembunuh, BN zalim, BN jahanam” (murderer Najib, cruel BN, go to hell, BN)and “Reformasi!”

Teoh, the political secretary of Seri Kembangan assemblyman Ean Yong Hian Wah, was taken in for questioning by the MACC yesterday at its 14th floor office in Plaza Masalam in Shah Alam.

MACC said he was freed but his body was later found sprawled on the roof of a five-storey building next door.

It is unclear if Teoh, a former journalist with Chinese daily Sin Chew Jit Poh, fell or jumped from the MACC office.

DAP’s Ronnie Liu said he could not understand how this could have happened.

Forensic investigators examine the body of Teoh Boon Hock for clues. Teoh was found dead next to the MACC’s office today, after being taken in for questioning yesterday.

At a press conference, the MACC director of investigations Datuk Mohd Shukri Abdul said Teoh was questioned from 5pm yesterday to 3.45am and was released soon after.

However, Teoh apparently said he was tired and so he rested on a settee in the lobby. He was seen sleeping on the settee at 6am.

At about 1.30pm, Shukri said, they heard that a body had been found on the 5th floor of the adjacent building and when one of the MACC officers went to investigate, he realised it was one of their witnesses.

Shukri said Teoh was not a suspect but was questioned as part of their investigations into the misuse of state allocations.

Police have not allowed anyone to view Teoh’s body, which has still not been removed at 6.30pm, when his brother was at the scene. According to witnesses at the scene, the body was finally removed about 9.20pm.

In an immediate reaction, DAP supremo Lim Kit Siang expressed shock and asked in his twitter account, “Is there now the first case of death in custody, not police but MACC? If so, heads must roll!”

The DAP leader is in Penang and said he was waiting for a full report about the tragedy.

“What has this country come to?” he asked, adding later he and other Pakatan Rakyat leaders will meet the MACC on Friday for an explanation.

According to Kit Siang, Teoh, an Alor Gajah boy, was to register his marriage tomorrow.

Kit Siang also confirmed he and Anwar will meet reporters at the MACC building in Shah Alam at 10am Friday.

Teoh was taken in for questioning yesterday after MACC officers raided Ean Yong’s office in the State Secretariat as they were investigating complaints about the failure of state allocations to reach the people.

Selangor State Assembly Speaker Teng Chang Khim weighed in by saying the MACC is responsible for the incident.

His lawyer M Manoharan, who accompanied Teoh to the MACC office yesterday, said he had looked normal and showed no signs of being under stress.

“He was happy and looked composed. I had advised him how to handle the interrogation as I was not allowed in during questioning,” he said.

Manoharan, who is the Kota Alam Shah assemblyperson, last saw Teoh at around 7pm yesterday.

The brother and sister of the late Teoh are consoled by Puchong MP Gobind Singh Deo (R), after they arrive at the MACC office.

Ean Yong said it was highly unlikely Teoh took his own life since he was due to be married tomorrow.

"Furthermore, there was no reason for him to linger (after the interrogation) because his car was here," he added.

Selangor executive councillor Elizabeth Wong expressed shock over Teoh’s death and added to the chorus that MACC was responsible for it.

“This tragic incident is another reminder of the recklessness of supposedly public institutions like the MACC in pursuing the goals of their political masters,” she said in a statement.

Wong said MACC investigations director Datuk Mohd Shukri Abdul’s explanation flew in the face of logic, adding that the authority should operate within acceptable guidelines when conducting interrogations.

“Even the police stops interrogating suspects at 6pm. Did the MACC think it holds powers greater than the PDRM when it interrogated Teoh from 5pm to 4am the next day?” she asked.

She said the incident has prompted her not to allow her staff to be questioned by the MACC unless accompanied by legal counsel, adding the police should also seal the office for investigations.

“Datuk Mohd Shukri … should save whatever honour he and the MACC have left by resigning,” said the Bukit Lanjan assemblywoman.

In a statement, Penang Chief Minister Lim Guan Eng said the MACC must bear full responsibility for this death as Teoh was in their custody at the time.

“MACC should stop its political persecution of PR, especially DAP leaders and members, that does not serve the interest of fighting corruption or justice,” he said. “Such political games have caused the loss of life of a bright young idealistic DAP member.”

“There must be a full investigation on how he died. Unless MACC can clear its name, the public may suspect that Teoh was mistreated and MACC had a hand in his sudden death. There must be full transparency and accountability.

“DAP extends its condolences to Teoh’s family for this tragic loss and assures them that all steps will be taken to ensure that the culprits or those responsible be punished.”

Sekinchan assemblyman Ng Swee Lim, who was weeping openly at the press conference, said he had wanted to take Teoh for seafood yesterday.

Meanwhile, PKR vice president K. Sivarasa calls this a “death in suspicious circumstances.”

PKR assemblyman Xavier Jeyakumar is questioning why a normal young man would want to kill himself over being questioned about state allocations.

A vigil organised for Teoh outside the MACC office was held at 8.30pm tonight. A group of youth unveiled a banner saying: "MACC we want answers and the truth".

By 9.20pm, the scene was beginning to evoke memories of Reformasi protests as at least 200 people had gathered.

Sacrilegious Acts by Unbelieving Spies in Church

IGNORANCE CAN BE FORGIVEN BUT MALICE MUST BE CONDEMNED

I have just been asked what I think of the recent event in which two journalists from Al Islam surreptitiously joined a worship service in a Catholic church, supposedly to verify if there are Malay Christians in the church. LINK1 Malaysiakini; LINK2 (Nutgraph); LINK3 (STAR).

In general I have no problem with Muslims coming to churches to spy on us. Indeed, we Christians welcome all visitors and that includes spies who harbor ill feelings and mischievous intent towards us. After all, it is only when people hear the good news being preached that they then realize the need to receive freely God’s healing grace and salvation. Hopefully, even spies may be positively impressed and return the good will that should be evident in an ambience filled with Christian love and fellowship.

We need however, to note that the act in which the two Muslims took communion and spit off the host (bread) is not acceptable to Catholics. Catholics will be offended by such an act of sacrilege (given their doctrine of transubstantiation). Hmm – I wonder whether they managed to spit out the wine served in the communion.

The question is whether these Muslims acted out of ignorance or out of malice. By malice I mean an act intended to belittle or insult Catholic worship or incite prejudice or hatred from their readers. We can make a conclusion on their motive based on how they report it in Al Islam.

If they acted out of ignorance, it is reasonable that the Catholic Church demands an apology from these Muslims. If the journalists from Al Islam admit that they have acted out of ignorance, the Church will accept their apology.

But if their reportorial piece shows evidence of malice – a deliberate insult, belittling an object deemed holy by the Catholics – that is disseminated in the media with no hint of regret, then I think it is fair that a police report be made with expectations that the authorities bring these people to task. A deed (however awful) done in private and kept in private may be addressed in private. But a deed done in public and publicised as such demands a public response.

I am confident that the Church remains open to any sign of regret from Al Islam and will be magnanimous enough accept any apology that is conveyed with an assurance that such a deed will not be repeated in future.

There is no need to demand a legally entitled pound of flesh even though the Penal Code allows for it. As the STAR (13/07/2009) reports, “It is learnt police have classified the case under Section 298A (1) of the Penal Code for causing disharmony, disunity or feelings of enmity, hatred or ill will, or prejudicing harmony or unity on religious grounds. If convicted the duo could be jailed from between two years and five years.”

I would like also to put on record that many of us disagreed with the severe punishment introduced when the Penal Code was amended in the mid-1980s since the provisions can easily be abused by authorities to suppress freedom of religion based on all sort of vague notions about acts “causing disharmony, disunity of feelings or enmity etc”. Indeed, the Penal Code can even be used against reformers within different religions who speak up against abuse of power by incumbent authorities within their own religious tradition.

In short, the Penal Code as it stands denies believers of all religions of their liberty of conscience. However, this is a different matter from what Al Islam seems to be doing when it publicizes the covert activities of its journalists.

Conversion: Non-Muslim Family No Right To Inheritance

PETALING JAYA, 8 July 2009: There is no avenue for a deceased Muslim convert's next-of-kin to lay claim to his or her estate, as civil laws like the Distribution Act 1958 do not apply to the Muslim deceased, lawyers said.

Instead, the estate goes to the Muslim treasury, Baitulmal, which is meant to distribute the assets among poor Muslims, hence denying the right to inheritance among non-Muslim family members.

In response to the High Court judgment that Mohan Singh a/l Janot Singh was a Muslim and his religion at the time of death should be determined by the Syariah Court, lawyers told The Nut Graph that legal amendments to address the distribution of a convert's estate are imperative.

What happens?

When a non-Muslim dies without a will, the estate is divided among the next-of-kin subject to the Distribution Act.

But for a deceased Muslim, his or her estate is subject to the Islamic laws of faraid (Muslim inheritance and distribution law). Under such circumstances, non-Muslims are prohibited from inheriting Muslim estates, and vice-versa. This is under the Syafie school of thought, which Malaysia adopts for its Islamic laws.

The law has yet to be tested in respect of a deceased Muslim convert who has a will, says lawyer Balwant Singh Sidhu, who represented the Malaysian Consultative Council on Buddhism, Christianity, Hinduism, Sikhism and Taoism. The council was a respondent in the judicial review involving Mohan's religious status.

"When the Distribution Act was enacted in 1958, nobody thought of converts because there were few at the time. Since this Act applies to non-Muslims only, and Muslims are covered by syariah enactments on inheritance, what about converts who drew up their will when they were non-Muslims?" Balwant said in a phone interview.

No rights

The absence of specific laws to address the peculiar scenario involving a convert has led civil courts to side with Islamic laws that prohibit non-Muslims from inheriting the estate of Muslims.

Balwant referred to the case of Majlis Agama Islam Wilayah Persekutuan v. Lim Ee Seng in 2000, where the High Court dismissed a wife's claim to her Chinese Malaysian husband's estate because he had converted to Islam.

The wife had commenced proceedings for the Letters of Administration — documents that authorise a court-appointed administrator to manage her late husband's estate — but the Federal Territory Islamic Religious Council stepped in to lay claim to the inheritance.

Balwant noted that the Shah Alam High Court, in declaring its judgment on Mohan's case, did not address his next-of-kin's rights to inheritance despite the matter being raised in submissions.

The appeal against the High Court's decision has already been filed at the Court of Appeal, and Balwant said he would raise the matter of inheritance rights during the hearing.

Need to amend laws

In the case of Mohan, whose Muslim name, according to his conversion certificate, was Mohammad Hazzery Shah Mohan Abdullah, Baitulmal will be the beneficiary of his estate.

The Muslim treasury in Selangor is managed by the Selangor Islamic Council (Mais).

Lawyer for Mohan's family Rajesh Kumar said Mohan did not make a will, and as a Muslim, his estate will not be governed by the Distribution Act but by Islamic law.

Besides his sisters and stepfather who are Sikh, he leaves behind a wife and daughter who are non-Muslim, and from whom he is estranged.

"Laws definitely need to be amended to ensure the next-of-kin are not deprived of their rights. In respect of converts, the law also needs to be clearer, such as having the next-of-kin present so that they can acknowledge that the conversion took place," Rajesh said in a phone interview.

Mais's lawyer Haniff Khatri Abdulla, when contacted by The Nut Graph, said the religious council was discussing Mohan's estate this week, and that he would only be able to comment further next week.

Religious council's discretion

K Shanmuga, who also represented Mohan's family in the High Court, said although the non-Muslim next-of-kin had no legal rights to a convert's inheritance, the state religious council could decide to "donate" a portion of the deceased's estate to the family at its discretion.

He said to his knowledge, this has happened once, so far. It was the case of a firefighter in Malacca whose family received RM100,000 or half his estate, 13 years after his death.

The firefighter, Abdul Wahid Lim Abdullah, had died on duty. The family only discovered his conversion to Islam after his death.

In 2005, the Malacca Islamic Religious Council (Maim), in response to his family's plight, then decided to donate half the estate to help them make ends meet.

In the case of Mount Everest climber M Moorthy, it was out of public pressure and his brother's compassion that his widow S Kaliammal was able to receive Moorthy's estate.

Kaliammal's solicitor at the time, A Sivanesan, told The Nut Graph that the widow received an initial RM100,000 as a gratuity, and after Moorthy was promoted to sergeant posthumously, she also received his pension in full and continues to do so.

Moorthy's two properties which went to his brother, who became Muslim through marriage, were later given to Kaliammal, but only after the brother obtained the agreement of the Federal Territory Islamic Religious Council.

"This was an exceptional case and is definitely not the norm. It was exceptional because it shook the whole nation and drew international attention, so the government had to be seen as liberal," said Sivanesan, who is also a Perak DAP assemblyperson.

"The authorities cannot act like this on a case-to-case basis because each case has a different scenario," the still-practising lawyer said. He added that there were more cases involving the conversion of one spouse but with different circumstances, which had not been highlighted to the media.

"The government must study all the different scenarios and make changes to the laws," Sivanesan said.

KUALA LUMPUR: Special units have been set up under both the Home, and the Information, Communications and Culture Ministries to monitor blogs and ensure that the content adheres to local laws.

Minister Datuk Seri Dr Rais Yatim, who is in charge of the communications portfolio, said both ministries would also exchange information between themselves to ensure maximum monitoring.

Besides monitoring, Dr Rais said his ministry also held meetings and dialogues with bloggers and website operators to inform them about government policies. “We inform them about the various laws that they should be aware of when they blog, especially those relating to racial harmony and national security. “We also remind them about the existence of legislation such as the Sedition Act, Defamation Act and Internal Security Act,” he said.

Earlier, he told both Shamsudin Mehat and Datuk Dr Yeow Chai Thiam that the Government would adopt an “open approach” towards the new media. “The Government encourages people to use the internet to search for information and knowledge as this helps to increase the broadband usage in the country,” he said.

Dr Rais said the Malaysian Communications and Multimedia Commission also organised programmes to promote awareness on proper usage of internet, such as cyberspace security, publication of articles, interviews in electronic media and in advertisments.

To a question from Ahmad Hussin whether the Government intended to draw up a code of ethics for bloggers as they had the power either to unite or wreck society, Dr Rais said the Home Ministry would monitor the bloggers under the Printing and Publications Act. “My ministry will monitor these blogs under the Communications and Multimedia Act,” he said.

He said such a move would be ineffective and could cause dissatisfaction among the people.

Dr Rais said the move was to protect Malaysian children from online smut.
